Liability & Good Samaritan Laws

Sometimes caterers, synagogues, and event spaces are nervous to donate food. They don’t have control of how the food is kept safe and cold after it leaves. They are worried that if someone gets sick, they could be sued. But it turns out there are some federal laws that protect people trying to do the right thing. You can read about these laws here and send them to a caterer you want to use.

The Bill Emerson Good Samaritan Food Donation Act grants liability protections to “persons and gleaners” who make good faith donations of food to nonprofit organizations for ultimate distribution to needy individuals at zero cost or at a good Samaritan reduced price.  New amendments passed on January 5, 2023, also grant liability protections to “qualified direct donors” who donate directly to needy individuals at zero cost.  Qualified direct donors include: retail grocers, wholesalers, restaurants, caters, and more (see below).”
